Very frustrating that the ALF my father is living in is insisting on 30 days notice for moving him out, even though his doctors have all agreed he needs more attentive care. I'm moving him out anyway, but sad that he has to deplete his bank account to pay for a month in a place he will not be. Is anyone aware of any recourse?


He's not even lived in this place one full month yet and we quickly determined he needed skilled care. I know the 30 days is to give them time to turn over the room, but he's barely put a dent it in. :(

When this happened to us, we spoke firmly to the director of the AL and they finally admitted that they had admitted mom in error, that she needed a much higher level of care

I believe they refunded the "community fee" and waived part of the month's rent.

Thats how the contract probably reads. You would want the same consideration if it was the other way around. I would think u won't need to pay the full month. You can move him anytime you want, but he is expected to pay that 30 days.

Read ur contract and see about the "care" part. With my Mom if she was in rehab for more than 2 wks, the care part dropped off. Lets say Dads full month was not till July 31st, you have paid for that. Todays the 11th and ur moving him. So August 10th is the 30 days. So you get prorated for the 10 days of the next month. You don't pay for the full month. Maybe just the rent and not the care because they are not giving it. ALs are like apts, ur there one day into the next month, and you pay the whole months rent.

Read the contract and then talk to the Administer/Director.

That is so sad, but the contract you sign going in is the contract you sign.
At my brother's ALF after a year residency the amount upon vacating a clean premises was fully refunded as per day you left. That is to say his room was not cleaned for one half month while moving out, nor available, but once that was done refund was in full. This was all stipulated in one of the most thorough contracts I have seen. They even said how much the yearly raise would be (3-5%) barring anything unforeseen (of course, then Covid hit). Inflation is a factor now, as well.
